Kisoro District Sued for Alleged Recruitment Bias and Discrimination

The Kisoro District Local Government and Kisoro Municipal Council, along with several officials, are facing a civil lawsuit filed in the High Court of Uganda at Kabale over alleged irregularities in the recruitment process for senior law enforcement positions.

The plaintiff Agaba Witness, a male Ugandan, resident of Kigongi B Cell, Kigongi Ward, Central Division, Kabale Municipality, Kabale District, is seeking general and punitive damages totaling Shs 200 million, claiming he was unfairly excluded from shortlists for law enforcement roles under Kisoro District Service Commission advertisements No. 001/2025.

According to court documents, Agaba holds a Bachelor’s degree in Public Administration and Management, formal police training, and over ten years of law enforcement experience. Despite meeting the advertised qualifications, he was excluded from the first and second shortlists, prompting him to raise complaints of possible discrimination and tampering in the recruitment process.

Agaba reportedly lodged complaints with multiple oversight bodies, including the Inspector General of Government (IGG), the State House Anti-Corruption Unit, and the Ministry of Public Service. Court papers indicate that the recruitment process continued despite these complaints, and the plaintiff alleges that conflicts of interest and favoritism influenced the eventual hiring decisions.

Frances Cantezi Mugisha, Secretary of the Commission;

Moses Remye Mukamusoni, Deputy Town Clerk of Kisoro Municipal Council;

Beatrice John Nyakahuma, Senior Human Resource Officer;

Ayub Kisubi, Town Clerk; and the Chief Administrative Officer of Kisoro District.

Agaba asserts that the defendants acted with “impunity” by ignoring his repeated requests to halt the recruitment pending investigations and that some technical personnel on the interview panel had potential conflicts of interest.

He also claims that some positions were filled without proper adherence to the job descriptions and qualification standards issued by the Ministry of Public Service.

He is asking the High Court to award general and punitive damages, 18% interest from the date of judgment until full payment, and costs of the suit.

In response to this, Kabale High Court has given the defendants 15 days to file their defense, failing which the court may proceed in their absence.
