RUKUNGIRI: The Forum for Democratic Change (FDC) leaders in Rukungiri District have declared Monday a public holiday dedicated to prayers and fasting for Dr. Kizza Besigye, calling for his complete release from military court proceedings.
Dr. Besigye is currently facing treason charges in the General Court Martial. However, in a landmark ruling delivered on Friday, Justice Monica Mugenyi of the Supreme Court declared Section 117(1)(h) of the Uganda People’s Defence Forces (UPDF) Act unconstitutional. This section had previously allowed military courts to try civilians.
Justice Mugenyi emphasized that the General Court Martial (GCM) does not meet the standards of independence or impartiality as required by Uganda’s Constitution, specifically under Article 28(1), which guarantees the right to a fair trial.
Despite the ruling, President Yoweri Museveni expressed disappointment on Saturday, stating that he would not implement the Supreme Court’s decision.
He defended the military court system as essential for national security and insisted that civilians accused of certain crimes, such as illegal possession of firearms, should still face trial in military courts.
